Conditions or Reasons:The development hereby approved has been assessed against <TxtPolicies> and material considerations, including third party representations. It has been concluded that the development, subject to the conditions imposed, would accord with the development plan and there are no other material considerations to justify a refusal of permission.
1) The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

Reason: To comply with Section 91(1) of the Town and Country Planning Act 1990 as amended by Section 51 (1) of the Planning and Compulsory Purchase Act 2004.
2) Before the building operations hereby permitted are commenced, samples and details of the proposed external materials shall be submitted to and approved in writing by the Local Planning Authority and no external materials shall be used other than those approved.

Reason: To ensure that the external appearance of the building is satisfactory. In accordance with the following policy number(s), G5(7) of the Guildford Borough Local Plan 2003.
3) Prior to the commencement of the development, detailed large-scale drawings, including materials, of the railings surrounding the external play area at the southern end of the site shall be submitted to and approved in writing by the Local Planning Authority. Only the approved details shall be implemented.

Reason: To ensure that the external appearance of the development is satisfactory. In accordance with the following policy number(s), G5(1) and G5(7) of the Guildford Borough Local Plan 2003.
4) Prior to the commencement of development details of the slab levels of the proposed buildings and existing and proposed ground levels shall be submitted to and approved in writing by the Local Planning Authority. The constructed development shall not vary from the approved levels.

Reason: In order to ensure a satisfactory form of development. In accordance with the following policy number(s), G5(2) of the Guildford Borough Local Plan 2003.
5) The premises shall be used for B1(a) offices and a community centre and for no other purpose (including any other purpose in Class B1 or D2 of the Schedule to the Town and Country Planning (Use Classes) Order 2005, (or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification).

Reason: In granting this permission the Local Planning Authority has had regard to the special circumstances of this case and wishes to have the opportunity of exercising control over any subsequent alternative use. In accordance with the following policy number(s), CF1 and G1(3) of the Guildford Borough Local Plan 2003, the Queen Elizabeth Park Development Brief 1999 and the S106 agreement attached to planning approval 02/P/1632
6) Works related to the construction of the development hereby permitted, including works of demolition or preparation prior to building operations, shall not take place other than between the hours of 8 am and 6 pm Monday to Friday and 8 am to 1.30 pm Saturdays and at no time on Sundays or Bank or National Holidays.

Reason: To protect the neighbours from noise and disturbance outside the permitted hours during the construction period. In accordance with the following policy number(s), G1(3) of the Guildford Borough Local Plan 2003.
7) Before the use hereby permitted commences, the building shall be sound insulated in accordance with a scheme to be submitted to and approved in writing by the Local Planning Authority, and the approved sound insulation shall be retained and maintained for the duration of the use.

Reason: To safeguard adjoining premises and the area generally from noise and disturbance. In accordance with the following policy number(s), G1(3) of the Guildford Borough Local Plan 2003.
8) All ventilation of smoke, steam and cooking fumes to the atmosphere shall at all times be filtered to avoid nuisance from odours, grease or smoke to persons in neighbouring or nearby properties. Details of the nature and location of such ventilation and filtration equipment shall be submitted to and agreed in writing by the Local Planning Authority before installation and such equipment shall be installed before the use hereby approved commences and shall thereafter be maintained.

Reason: To protect neighbouring properties and the area generally from odours. In accordance with the following policy number(s), G1(3) of the Guildford Borough Local Plan 2003.
9) Details, including the acoustic performance of all external fixed plant, machinery and ventilation systems or ducts to be installed on the building hereby approved and within its curtilage, shall first be submitted to and approved in writing by the Local Planning Authority. All plant, machinery and equipment (including fans, ducting and external opening) installed or operated in connection with the carrying out of this permission shall be so enclosed and/or attenuated such that the noise emitted does not increase the ambient equivalent continuous noise level as measured according to British Standard BS4142:1990 at any nearby residential property or noise sensitive premises. [This must include a correction factor of 5dB(A) to account for any particular tonal quality].
 
Reason: To safeguard adjoining premises and the area generally from noise and disturbance. In accordance with the following policy number(s), G1(3) of the Guildford Borough Local Plan 2003.
10) Prior to any development or demolition commecing, fencing at least 2.4 metres high shall be erected around the entire edge of the grass plot where the London Plane tree is located, comprising a vertical and horizontal framework of scaffolding, well braced to resist impacts, with vertical tubes spaced at a maximum interval of 3 metres, in accordance with Figure 2 of BS5837:2005. Weldmesh panels on rubber or concrete feet are not resistant to impact and should not be used.

Reason: The existing trees represent an important public visual amenity in the area. In accordance with the following policy number(s), G1(12) and NE5 of the Guildford Borough Local Plan 2003.
11) Within any area fenced in accordance with condtion 10 above, nothing shall be stored, placed or disposed of on or below ground, the ground level shall not be altered, no excavations shall be made, nor shall any fires be lit, and the fencing shall be maintained in such a position until all equipment, machinery and surplus materials have been moved from the site.

Reason: The existing trees represent an important public visual amenity in the area. In accordance with the following policy number(s), G1(12) and NE5 of the Guildford Borough Local Plan 2003.
12) No trees or hedgerows within the boundary of, or adjacent to the site, expect those shown on the approved plan(s) or otherwise clearly indicated in the approved details as being removed, shall be felled or pruned in any manor; nor shall any roots be severed, pruned or removed; without the prior consent of the Local Planning Authority, during development, and for a period of five years after completion of the development hereby approved.

Reason: The existing trees represent an important public visual amenity in the area. In accordance with the following policy number(s), G1(12) and NE5 of the Guildford Borough Local Plan 2003.
13) The use of the community facility's floorspace hereby approved shall not operate other than between the hours of 07.00 - 23.00 on Mondays to Saturdays inclusive and between the hours of 09.00 - 22.30 on Sundays, Bank and National holidays.
 
Reason: To safeguard the residential amenities of neighbouring properties in accordance with policy G1 (3) of the Guildford Borough Local Plan 2003.

Informative notes:1) This decision relates expressly to drawing numbers 101 rev C, 100 rev B, 102 rev C date stamped 23rd February 2006 and drawing number 105 rev A date stamped 16th March 2006.
2) The applicant is advised that adequate control precautions should be taken to control dust on the site, so as to prevent a nuisance to inhabitants in the locality. This may involve the use of dust screens and wetting of the site areas to inhibit dust.
3) The applicant is advised that only silencing piling equipment should be used to minimise noise disturbance.
4) The applicant is advised that no burning of materials should take place on the site during the construction process. Should a bonfire be lit it may be controlled under the Environmental Protection Act 1990 if the local authority considers it to be a statutory nuisance. Further information may be obtained from the Head of Environmental Health and Licensing.
5) The applicant is advised that prior to the commencement of development details showing the provision for the disposal of surface water emanating from this development, shall be submitted to and approved by the Engineering Manager, Guildford Borough Council. Provision for the disposal of surface water shall be made at the initial stage of development of the site and shall be completed and be operational prior to any impermeanble drained being created on site.
