Conditions or Reasons:1) The proposed block of flats, by virtue of its high density and excessive depth, would appear unduly bulky and out of character with the existing pattern of development, and would represent an overdevelopment of the site. The proposal would therefore fail to respect the character and appearance of the area, and would be contrary to policies G5 and H4 of the Guildford Borough Local Plan 2003 (as saved by CLG Direction dated 24/9/07).
2) The applicant has failed to enter into a S.106 legal agreement to provide a financial contribution in line with the Council's Thames Basin Heaths Special Protection Area (TBHSPA) Interim SPA Avoidance Strategy (adopted September 2006). The local planning authority, in the absence of an appropriate assessment or any alternative mitigation measures, is therefore unable to satisfy itself that the proposals would not have an adverse effect on the integrity of the TBHSPA. In this respect, significant concerns remain with regard to the adverse effect on the integrity of the TBHSPA, including the deterioration of the quality of the habitat and increased disturbance to birds. As such, the development is contrary to policy SE7 of the Surrey Structure Plan 2004 (as saved by CLG Direction dated 21/9/07) and policies NE1 and NE4 of the Guildford Borough Local Plan 2003 (as saved by CLG Direction dated 24/9/07).
3) The following levels of contribution and provisions would normally be sought from the applicant, had the application been supported.

A contribution of £3,810 for improvements at the SPA avoidance site at Riverside.
A minimum rating of level three of Code for Sustainable Homes.

Without a completed legal agreement securing these contributions and provisions, the proposal is contrary to policy G6 of the Guildford Borough Local Plan 2003 (as saved by CLG Direction dated 24/9/07), and the Council's Supplementary Planning Documents 'Sustainable Development and Construction' (December 2005) and the Thames Basin Heath Special Protection Area Interim SPA Avoidance Strategy (September 2006).
