Commercial Bonfires


It is an offence under the Environmental Protection Act 1990 to burn waste material from a commercial activity such as construction or demolition under Section 34, Duty of Care (this page opens in a new window).

However, for certain types of waste including untreated timber and plant material it may be possible to obtain an exemption under Section 30 of the Environmental Permitting (England and Wales) Regulations 2007.  You can contact the Environment Agency on 08708 506506.  Alternatively, exemption permit notifications may be made online from the Environment Agency (this page opens in a new window)

Please note that exemptions do not apply to painted or treated timber.  These may not be burned because of the fumes released during combustion. 

The exemption does not permit a nuisance to be caused to neighbours or others in the area.  Under the Environment Protection Act 1990, where the smoke from a bonfire constitutes a ‘statutory nuisance, an abatement notice can be served by the Council to prevent further bonfires. 

Furthermore, the burning of any material as part of a business would cause an offence under The Clean Air Act 1993 if it gave rise to Dark or Black Smoke.
