From 1 October 2008, an Energy Performance Certificate (EPC) is required whenever a dwelling in the social or private rented sectors is let to a new tenant.

The certificate is not needed where rooms in a house-share are let on separate contracts, but is required if all the tenants are on a single contract.

The certificate is also part of the Home Information Pack when a home is sold.

The EPC must be made available free of charge to prospective tenants at the earliest opportunity. A copy of the EPC must be given to the person who takes up the tenancy.

EPCs must be produced by an accredited assessor, but landlords are free to seek accreditation for themselves and their employees and so become competent to certify their own properties.
The EPC shows running costs and carbon dioxide emissions. Each rating is shown on an A – G rating scale, similar to those used for fridges and other electrical appliances. The certificate also shows what work might improve the energy rating.

Although there is no legal requirement to carry out works identified on an EPC, Guildford Council may require works in rented property to deal with poor heating and insulation. Where a tenant is not provided with the EPC this is an offence, this will be enforced by Surrey County Council Trading Standards (this page opens in a new window).
