Houses in multiple occupation (HMO)


What is an HMO?
HMO stands for House in Multiple Occupation.  The Housing Act 2004 changed the definition of HMO, this affects which properties regulations now apply to.

A HMO is a building or part of a building, such as a flat that:

  • Is occupied by more than one household and where more than one household shares – or lacks an amenity such as a bathroom, toilet or cooking facilities.
  • Is occupied by more than one household and which is a converted building – but not entirely self-contained flats (whether or not some amenities are shared or lacking)
  • Is converted self-contained flats, but does not meet as a minimum standard the requirements of the 1991 Building Regulation, and at least one third of the flats are occupied under short tenancies.

The building is occupied by more than one household:

  • as their only or main residence
  • as a refuge for people escaping domestic violence
  • by students during term time
  • for other purposes prescribed by the government.

A household is:

  • families (including single people, couples and same sex couples)
  • other relationships, such as fostering, carers and domestic staff.

The change in definition will impact on smaller shared houses, including those occupied by students, which have been brought back into the HMO definition.
 

Mandatory HMO licensing
Mandatory HMO licensing came into effect on 6th April 2006.  A landlord who lets a property that meets all the following criteria will be required to obtain a licence from the Council. 

An HMO must have a licence if all three of the following apply:

  • It is an HMO (see definition of HMO above)
  • It is three storeys or more (includes basements and attics)
  • It is occupied by five or more people.
  • Some occupants share an amenity I.e. kitchen/bathroom

HMO Standards
We are responsible for checking houses in multiple occupation to make sure:

  • They are in a satisfactory condition
  • Means of escape from fire are in place
  • Sufficient bathrooms and kitchens are provided
  • Adequate space is available to tenants
  • Proper management is in place.
