Houses in multiple occupation


We are responsible for checking houses in multiple occupation (HMO) to make sure:

  • They are in a satisfactory condition
  • Have satisfactory means of escape from fire
  • Sufficient bathrooms and kitchens
  • Have adequate space
  • Proper management.


What is an HMO?

The Housing Act 2004 has introduced a new definition for HMOs.

A HMO is a building or part of a building, such as a flat that:

  • Is occupied by more than one household and where more than one household shares – or lacks an amenity such as a bathroom, toilet or cooking facilities.
  • Is occupied by more than one household and which is a converted building – but not entirely self-contained flats (whether or not some amenities are shared or lacking)
  • Is converted self-contained flats, but does not meet as a minimum standard the requirements of the 1991 Building Regulation, and at least one third of the flats are occupied under short tenancies.

The building is occupied by more than one household:

  • as their only or main residence
  • as a refuge for people escaping domestic violence
  • by students during term time
  • for other purposes prescribed by the government.

A household is:

  • families (including single people, couples and same sex couples)
  • other relationships, such as fostering, carers and domestic staff.

The change in definition will impact on smaller shared houses, including those occupied by students, which have been brought back into the HMO definition.
 

Mandatory HMO licensing

Mandatory HMO licensing comes into effect from 6th April 2006 a landlord who lets a property, which meets all the following criteria, will be required to obtain a licence from the council. 

An HMO must have a license if all three of the following apply:

  • It is an HMO (see definition of HMO above)
  • It is three storeys or more (includes basements)
  • It is occupied by five or more people who share an amenity i.e. kitchen/bathroom

HMO standards

HMOs have to meet certain standards in relation to the following:

  • Means of escape in case of fire and other fire precautions
  • Amenities such as kitchens, bathrooms, toilets and wash hand basins
  • Overcrowding with regard to the number and size of rooms
  • General fitness for occupation
  • Management standards gas safety
  • Furniture fire safety
